Terms of Service

These terms are the agreement between you and Grzegorz Kegel ("we", "us"), Gwiezdna 9, 32-087 Zielonki, Poland, Poland, registration number sole proprietorship entered in CEIDG, NIP 5130216505, VAT number 5130216505, about your use of Augurhall: the encounter simulator at app.augurhall.com and the website at augurhall.com (together, "the service").

By making an account you accept these terms and our Privacy Policy. If you do not accept them, do not use the service. You can reach us at support@augurhall.com.

1. What the service is

Augurhall is a simulator for fantasy tabletop role-playing games. You describe a party of characters and an encounter; the service plays the fight many times with dice rolls and computer-controlled choices and shows you how the fights went: how often the party won, what happened along the way, and why.

The results are estimates. They come from simulated dice and from choices made by software, not by your players or your game master. Real games differ: people make other choices, tables use other rules and house rules, and the simulator does not model everything a character can do. Where the simulator cannot model something, it says so or leaves it out. We do not promise that any result matches what will happen at your table, and you should not rely on a result as a guarantee of anything.

2. Your account

3. Free and paid tiers

The service has a free tier and three paid tiers. Paid tiers are memberships of our Patreon campaign; Patreon takes the payment and its own terms apply to it (see the Purchase and Refund Terms). Each tier includes everything in the tiers below it.

Features marked "when available" are switched on by us; until then no tier includes them. We may add features to a tier. We will not remove a feature from a paid tier during a period you have already paid for.

Your tier follows your Patreon membership. If a Patreon payment fails, you keep your tier for 3 days; after that, or when the membership ends, the account returns to the free tier. What the free tier does not keep (checks older than 30 days, or beyond the last 25) is then deleted at the next nightly clean-up.

4. Fight credits

One credit is one simulated fight. Each tier has a number of credits for each calendar month (UTC):

A check reserves its fights when it starts and gives back the fights it did not run. A result we already hold for the same request costs no credits. Unused credits do not carry over: the count starts again at 00:00 UTC on the first day of each month. To keep the service available for everyone, we also limit how many fights one account may run in a day, how many checks may run at once and how often checks may be started; when you reach a limit, the service tells you.

5. Fight packs

You can also buy fight packs: fights that you use after the month's credits are spent. Packs are sold by our reseller, Stripe (through its Managed Payments service), as merchant of record; the Purchase and Refund Terms set out the prices, the 12-month expiry and your right of withdrawal.

6. Your content

You may upload characters (for example exported character sheets) and create checks, parties and encounters ("your content"). You keep whatever rights you have in your content. You give us the permission we need to store it, run it through the simulator and show the results to you, for as long as we hold it. Only you can see your checks, results and imported characters; we do not publish them.

Only upload content you have the right to use. Do not put other people's personal data in character names or other fields.

7. Acceptable use

Do not:

We may suspend or close an account that breaks these rules. Where it is reasonable, we will tell you first and give you a chance to explain. If we close a paid account without a breach on your side, we will refund the unspent part of what you paid us directly.

8. Availability and changes to the service

We work to keep the service running but do not promise that it is always available or free of errors. We may change, add or remove features, game data and the simulator itself; a change can change the results of a check you run again. We will tell you in advance, by email or in the service, about a change that takes away a paid feature you rely on.

9. Game content and licences

The game rules the simulator uses are published under open licences. The notices those licences require, and the licences of the software we use, are on the Content Licence and Attribution page. Augurhall is not affiliated with, sponsored by or endorsed by the publishers of the games it simulates.

10. Liability

Nothing in these terms limits liability that cannot be limited by law, including liability for intent or gross negligence, for death or personal injury, or your rights as a consumer under the law of the country where you live.

Otherwise, the service is provided as it is. Because results are estimates (section 1), we are not liable for decisions you make based on them. Our total liability to you for any claim about the service is limited to the amount you paid us, directly or through Patreon or our reseller, in the 12 months before the claim.

11. Ending the agreement

You can stop using the service and delete your account at any time. Ending a Patreon membership is done on Patreon. We may end this agreement with 30 days' notice by email, or at once for a serious breach of section 7.

12. Changes to these terms

When we change these terms we publish the new version with a new version number and date. If the change matters to you, we ask you to accept it the next time you sign in. If you do not accept it, you can download your data and delete your account.

13. Law and disputes

These terms are governed by the law of Poland. Disputes go to the courts of Poland. If you are a consumer, you also keep the protection of the mandatory law of the country where you live and may bring a claim in its courts.
